Terms of Service

Censum is a personal AI assistant that may help with chat, routines, summaries, reminders, notifications, connected-service triage, and prepared actions. The Services may surface items that need your attention, generate drafts or briefings, and personalize results based on your profile, preferences, feedback, and connected data.

Some features may be released as beta, TestFlight, experimental, or limited-availability features. Beta features may be incomplete, change without notice, or stop working.

The Services are currently available only to users located in the United States. You must be at least 13 years old to use the Services and represent that you can legally agree to these Terms.

• You may need an account to use some or all of the Services
• You must provide accurate account information and keep it up to date
• You are responsible for maintaining the security of your account, devices, and connected services
• You are responsible for all activity that occurs under your account, except to the extent caused by our breach of these Terms or applicable law
• You should notify us promptly if you believe your account or connected service has been compromised

If you connect third-party services, such as Gmail, Google Calendar, or work tools, you authorize Censum to access, process, and use the data made available through those services as needed to provide the features you request or configure. This may include reading, summarizing, organizing, labeling, drafting, modifying, or otherwise processing content depending on the permissions you grant and the actions you approve or configure.

Third-party services are governed by their own terms, privacy policies, APIs, outages, rate limits, and permission systems. We are not responsible for third-party service changes, errors, downtime, data loss, or actions those providers take. You are responsible for ensuring you have the right to connect any account or data source, including employer-managed accounts.

The Services use AI systems. AI-generated outputs, summaries, classifications, drafts, recommendations, profile memories, and suggested actions may be inaccurate, incomplete, outdated, offensive, or unsuitable for your situation.

Censum is not a substitute for professional advice, independent judgment, legal review, medical advice, financial advice, security review, or operational review. You are responsible for reviewing and validating outputs before relying on them or sharing them with others.

Censum may prepare drafts, suggest actions, or, where supported and authorized, perform actions through connected services. You are responsible for reviewing action settings, permissions, drafts, and important outputs before approval or reliance.

Any action taken by Censum at your direction, with your approval, or according to settings you configure is treated as an action authorized by you. You are responsible for the consequences of those actions, including communications sent, calendar changes, email modifications, or other connected-service changes, except to the extent caused by our breach of these Terms or applicable law.

You agree not to:

• Use the Services in violation of any law, contract, policy, or third-party right
• Attempt to access another user's account, data, integrations, or private information
• Upload, generate, or transmit malware, harmful code, abusive content, or deceptive communications
• Use the Services to send spam, unlawful outreach, or unsolicited bulk communications
• Interfere with, probe, scrape, overload, or compromise the Services or related infrastructure
• Reverse engineer, extract, or misuse our software, prompts, models, systems, or security controls except as allowed by law
• Use the Services to build or benchmark a competing product without our written permission
• Circumvent rate limits, feature limits, access controls, or safety measures

Some features may be free, beta, or invite-only, and some may become paid in the future. If paid features are introduced, additional payment terms may apply. We may add, change, suspend, rate-limit, or remove features at any time, including limiting availability by region. We do not guarantee that the Services will be available, uninterrupted, secure, or error-free.

We and our licensors own the Services, including software, interfaces, systems, prompts, workflows, branding, and related intellectual property, except for content you provide.

You retain ownership of content you provide or make available through the Services. You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, display, transmit, and use that content as necessary to provide, secure, support, and improve the Services, comply with law, and enforce these Terms.

AI outputs may not be unique, and other users may receive similar outputs. Subject to these Terms, you may use outputs for lawful personal or internal business purposes.

Our collection and use of personal information is described in our Privacy Policy.

You may stop using the Services at any time and may request account deletion through the app where available or by contacting us. We may suspend or terminate access if we believe you violated these Terms, created risk for the Services or others, failed to pay applicable fees, or if we discontinue the Services.

After termination, your right to use the Services ends immediately. Certain sections of these Terms will survive termination where their nature requires it, including intellectual property, privacy, AI-output responsibility, disclaimers, limitations of liability, and dispute provisions.

If you download the app through the Apple App Store, you acknowledge that these Terms are between you and Triangl Labs, Inc., not Apple, and Apple has no obligation to provide maintenance or support for the app except as required by law. Apple and its subsidiaries are third- party beneficiaries of these Terms as they relate to your use of the iOS app.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND RELIABILITY.

WE DO NOT WARRANT THAT AI OUTPUTS WILL BE ACCURATE, COMPLETE, RELIABLE, SAFE, OR SUITABLE FOR YOUR USE CASE, OR THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR OPERATE WITHOUT INTERRUPTION OR ERROR.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIANGL LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, BUSINESS OPPORTUNITY, OR REPUTATION ARISING FROM OR RELATING TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

To the extent permitted by law, you agree to indemnify and hold Triangl Labs and its affiliates, officers, directors, employees, contractors, and agents harmless from claims, losses, damages, liabilities, and expenses arising from your use of the Services, your content, your connected services, actions taken at your direction or under your configuration, your violation of these Terms, or your violation of law or third-party rights.

These Terms are governed by the laws of Delaware, excluding conflict of law rules, except where consumer protection laws require otherwise. Before filing a claim, you agree to contact us so we can try to resolve the dispute informally.

We may update these Terms from time to time. If we make material changes, we will post the updated Terms here and may also notify you by email, through the app, or by another reasonable method. Continued use of the Services after changes become effective means you accept the updated Terms.
